ESPACE MOM is eager to respect and protect the privacy of its Customers and Visitors to the ESPACE MOM Site.

To this end, we have established this privacy policy in order to lay out the reasons we collect and process some of your personal data on our Site and, more specifically, when you place an Order with the Company.

To proceed with the Order of one (or more) Device(s) remotely via the ESPACE MOM Site, by email (in particular by sending our Form), or by telephone, you must register, either directly on the ESPACE MOM Website or directly with the ESPACE MOM Company and, therefore, must provide a certain amount of information.

For the purposes of this Privacy Policy, this is referred to as “Personal Data” or “Data”.

This Personal Data is collected and processed by ESPACE MOM.

We require this Personal Data to process your Order and deliver it.

Each Visitor to the ESPACE MOM Site and/or Customer of the ESPACE MOM Company is reminded that, pursuant to Article 4 of the General Data Protection Regulation No. 2016/679,

the following are considered “Personal Data”: “any information relating to an identified or identifiable natural person”, with an “identifiable natural person” referring to a natural person who can be identified, directly or indirectly, through an identifier, such as a name, an identification number, location, an online login ID, or one or more elements specific to their physical, physiological, genetic, psychological, economic, cultural or social identification”; and
the “processing” of Personal Data can be defined as “any operation or set of operations, whether automated or not, applied to personal data or sets of personal data, such as the collection, recording, organization, structuring, storage, adaptation, modification, extraction, viewing, usage, transmission, distribution or any other procedure making it available, or its reconciliation, interconnection, limitation, erasure or destruction”.

By registering and/or placing an Order, i.e. by purchasing one or more Devices on the ESPACE MOM Site, by email or telephone directly from the ESPACE MOM Company, the Customer must declare and acknowledge, beforehand, that they have read and/or accepted the terms of this privacy policy (hereinafter referred to as the “Privacy Policy”) unconditionally and without reservation.

This Privacy Policy is in accordance with Law No. 78-17 of January 6, 1978 relating to data processing, files and freedoms, revised by Law No. 2018-493 of June 20, 2018, and with Law No. 2004-575 of June 21, 2004 regarding confidence in the digital economy and the General Data Protection Regulation No. 2016/679 (the “GDPR”).

Any Visitor or Customer who sends Data that does not concern them to ESPACE MOM via the ESPACE MOM Site or by email or telephone, guarantees ESPACE MOM that they have obtained the prior written consent of the person concerned with respect to the communication of said Data to ESPACE MOM and the collection and processing thereof by ESPACE MOM in accordance with the terms of this Privacy Policy.

We reserve the right to request additional information in the event doubt arises with respect to the Data sent to us.
For the purposes of this Privacy Policy, a “Third Party” refers to a natural or legal person other than the ESPACE MOM Company, the Visitor, the Customer, or a Partner of the ESPACE MOM Company.

Editing and operation of the ESPACE MOM Site is provided by the ESPACE MOM Company, SARL (limited liability company) with a share capital of 9,000 euros, registered in the Trade and Companies Register of Saverne under number 489 317 677, headquartered at 3, rue Gustave Goldenberg 67700 Saverne, France.

The ESPACE MOM Company is the owner of the ESPACE MOM Site and all rights related thereto.

2 – SCOPE

This Privacy Policy outlines the policy for the collection, processing, use and disclosure of Personal Data provided by and/or collected from each Customer.

The goal of this Privacy Policy is to inform you of:

the precise nature of the Personal Data we collect and process;
how we collect and process this Personal Data;
why we need to collect and process this Personal Data;
how long we keep this Personal Data for;
your rights regarding the collection and processing of this Personal Data;
identification of the Personal Data Controller;
Optionally, the persons to whom this Personal Data may be transmitted and/or transferred.

This Privacy Policy supplements the legal notices and General Sales Terms of the ESPACE MOM Company which you can view directly at any time on the ESPACE MOM Website, or which you can obtain directly from the ESPACE MOM company by written or verbal request.

Pursuant to Article 5 of the General Data Protection Regulation No. 2016/679, the collection and processing of personal Data of Visitors to the ESPACE MOM Site and/or Customers of the ESPACE MOM Company by the ESPACE MOM Company follow these principles:

the processing of Personal Data is lawful, fair and transparent; Personal Data may only be collected and processed with the express consent of the Visitor or Customer;
personal Data is collected for specified, express, legitimate purposes, and is not processed in a manner unrelated to these purposes; the collection and processing of Personal Data is done for one or more purposes as defined in this Privacy Policy and, in particular, in order to allow the ESPACE MOM Company, its Partners and the ESPACE MOM Site to provide its services to Visitors and Customers, and for which the Visitors and Customers request it, to establish statistics or to enter into partnerships to improve the services;
the Company collects and processes as little Personal Data as possible: only Personal Data necessary (i.e., adequate, relevant, limited Personal Data) for (i) the proper performance of the services offered by or the objectives of the ESPACE MOM Company and (ii) the improvement of the services offered by the ESPACE MOM Company on the ESPACE MOM Site are collected and, where applicable, processed by the ESPACE MOM Company;
said Personal Data will be held for a limited time. Personal Data is kept for a limited period, which is indicated to the Visitor and the Customer in this Privacy Policy;
personal Data is collected with integrity and kept confidential so as to ensure appropriate security; the Personal Data Controller must devote the necessary, proportionate means to guarantee the integrity, security and confidentiality of Personal Data collected and processed by ESPACE MOM.

With respect to usage of the ESPACE MOM Site, pursuant to the requirements of Article 6 of the General Data Protection Regulation No. 2016/679, collection and processing of Personal Data may only occur if the Customer has expressly consented to collection and processing by the ESPACE MOM Company of their Personal Data and/or when the collection and processing of the Customer’s Personal Data is necessary for the proper performance of the services offered on the ESPACE MOM Site by the ESPACE Company and to which the Customer has subscribed.

We remind our Customers that, in order to place an Order for one or more Device(s) on the ESPACE MOM Website or by telephone or email directly from the ESPACE MOM Company, each Customer must first provide information directly on the ESPACE MOM Website or to the ESPACE MOM Company, including a certain amount of Personal Data and consent to and accept the ESPACE MOM Company’s General Sales Terms as well as this Privacy Policy without reservation and unconditionally.

We do not collect any Personal Data other than what is mentioned in this Privacy Policy.

3 – DEFINITIONS

All terms beginning with a capital letter, when not defined in this Privacy Policy, whether in the singular or plural, have the definition assigned to them in the ESPACE MOM Company’s General Sales Terms.

For the purposes of this Privacy Policy:

“Customer(s)” refer(s) to any natural person, accessing, visiting, browsing and/or using the ESPACE MOM Site for personal purposes, on an occasional or regular basis, who has registered on the ESPACE MOM Site (i.e. identified) and/or who purchases one (or more) Device(s) from the ESPACE MOM Company, in particular through the ESPACE MOM Site or remotely by telephone or email.

The “ESPACE MOM Website” refers to all web and mobile sites, along with the content thereon, accessible at the address: https://www.espacemom.com as well as all URL addresses under the domain name “espacemom.com”.

The “Company” and/or “ESPACE MOM” refers to the SARL (limited liability company) with a share capital of 9,000 euros, registered in the Trade and Companies Register of Saverne under number 489 317 677, headquartered at 3 rue Gustave Goldenberg, 67700, Saverne, France.

“Visitor(s)” refer to any natural person, accessing, visiting, browsing and/or using the ESPACE MOM Site for personal purposes, on an occasional or regular basis who is not identified.

4 – PERSONAL DATA COLLECTED BY ESPACE MOM ON THE ESPACE MOM WEBSITE OR DURING A REMOTE ORDER

1 – In order to register on the ESPACE MOM Site or to Order one or more Device(s) on the ESPACE MOM Site, or remotely by telephone or directly with the Company by email, the Customer must provide:

their title (required field);
first and last name (required field);
date of birth (not required);
complete postal address: address, postal code, city and country (required field);
phone number (required field);
information on how they discovered the ESPACE MOM Site or, if applicable, the ESPACE MOM Company;
email (required field);
and, when registering on the ESPACE MOM Site, they must create and enter a personal and confidential password enabling access to their personalized member account (hereinafter referred to as the “Registration Data”).

You can use social media to contact us directly or even to place an Order for a Device. Usage of these social media sites is likely to cause Data between said social networks and ESPACE MOM to be exchanged. We suggest you read the privacy policies of these social media companies before using them.

We will hold all Registration Data in our computer system and under reasonable security conditions for the duration indicated in Article 7 of this Privacy Policy.

In addition, any Visitor or Third Party who communicates their Registration Data for the purpose of Ordering one or more Device(s) directly to the ESPACE MOM Company via the ESPACE MOM Site, by telephone or by email to the email address contact@espacemom.com, becomes a Customer under the terms of this Privacy Policy. The Customer will then be provided with a member account on the ESPACE MOM Site (once they have registered and/or purchased a Device on the ESPACE MOM Site) or, when they purchase a Device by email or telephone, is identified as a Customer by ESPACE MOM.

2 – We also collect usage data of Customers on the ESPACE MOM Site, namely browsing and login frequencies, login and/or browsing IP address of the Customer and/or Visitor (when the latter has expressly agreed to this) including ESPACE MOM Site pages viewed by Visitors and Customers (hereinafter referred to as “Usage Data”).

We also collect a history of our Customers’ Orders (and their content) and a history and content of contacts and exchanges between you and us (hereinafter referred to as “Usage Data”).

3 – With regard to Orders placed directly on the ESPACE MOM Site, we do not collect any other Personal Data from our Customers.

All purchases made on the ESPACE MOM Site are managed by an independent Partner of the ESPACE MOM Company, the company SYSTEMPAY. Therefore, when you purchase one (or more) Device(s) on the ESPACE MOM Site, you must provide your banking details directly to our Partner SYSTEMPAY, since ESPACE MOM does not have access to and cannot collect your banking details.

However, for your complete information, our Partner SYSTEMPAY will subsequently confirm the purchase of a Device with us and provide us with the following information: name, email, address, transaction number assigned to the Order, Order number, the expiration date of the credit card used, and a part of your credit card number. We collect and keep this Data with the highest level of confidentiality so we can properly follow up on each Order if needed.

With regard to Orders placed directly with ESPACE MOM by telephone, you must provide us with your banking details when placing your Order, then ESPACE MOM will enter them in order to carry out your Order. Under no circumstances will we collect your banking details or process them for any purpose other than the Order.

With regard to Orders placed directly with ESPACE MOM by email, you must provide us with your banking details when placing your Order, then ESPACE MOM will enter them in order to carry out your Order. Your banking details are not collected or processed by ESPACE MOM.

We place a particular importance on not keeping our Customers’ banking details to guarantee them optimal security when making purchases with us.

5 – USE OF PERSONAL DATA COLLECTED BY ESPACE MOM THROUGH THE ESPACE MOM WEBSITE (OR DIRECTLY) AND PURPOSES THEREOF

1 – We collect and process the Registration Data of each of our Customers in order to:

identify and differentiate each Customer of the ESPACE MOM Company;
provide the Customer with proper functioning of the services to which they have subscribed, either directly with the ESPACE MOM Company by telephone or email or directly on the ESPACE MOM Site, namely in order to deliver the Device(s) purchased (i.e. delivery of their Order);
send Visitors or Customers newsletters relating to ESPACE MOM Company news, questionnaires or contests.
In this regard, Visitors and Customers are informed that the system set up by the ESPACE MOM Company is an “opt in” system, so the Visitor or Customer must have previously accepted and indicated that they wish to receive said newsletters, questionnaires or contests from the ESPACE MOM Company and provide the Personal Data necessary for this purpose, namely their name and email address;

2 – In addition, we perform a cross-analysis of the Registration Data and the Usage Data of our Customers in order to perform anonymized statistical analyses. This process allows us to establish statistical data to help us improve the services we offer to our Customers and to Visitors to the ESPACE MOM Site.

6 – DISCLOSURE OF PERSONAL DATA AND/OR PROCESSING OF PERSONAL DATA BY ESPACE MOM

ESPACE MOM places a particular importance on the confidentiality of the Data it collects from its Customers.

The Personal Data that the Customer communicates to ESPACE MOM on the ESPACE MOM Site, by telephone or by email, and collected by the ESPACE MOM Company are exclusively collected and processed by the ESPACE MOM Company in compliance with the provisions of the GDPR.

The Personal Data that the Customer communicates to the ESPACE MOM Company on the ESPACE MOM Site, by telephone or by email collected and processed by ESPACE MOM are not communicated or transferred to any Third Party for payment or for free, in any manner whatsoever.

The same applies to the processing of this Data.

However, Personal Data will be transmitted to Partners of the ESPACE MOM Company for the sole purpose of carrying out the Order placed by the Customer with the ESPACE MOM Company.

Therefore, the Customer’s Personal Data may be communicated to the Partner in charge of delivering the Customer’s Order, according to the information provided by the Customer. In this regard, our Partners make a commitment to ESPACE MOM not to use or process this Data for any purpose other than the successful delivery of the Order you have placed with us.

We may also communicate your Data to legal authorities with respect to fraud prevention or to customs services when the Order is delivered abroad.

Personal Data communicated by the Customer to the ESPACE MOM company are and will remain confidential. This Data will not allow the Customer to be identified by a Third Party.

7 – DURATION PERSONAL DATA WILL BE HELD

7.1 Registration Data is kept for the time necessary to allow the ESPACE MOM Company to provide the services for which the Customer has communicated them and for a period no longer than ten (10) years from the date of the last Order sent by the Customer.

7.2 Usage Data is kept for the time necessary to allow the ESPACE MOM Company a period not exceeding ten (10) years from the Customer’s last login to their member account or their last navigation on the ESPACE MOM website.

7.3 Customer Data is held mainly to allow the Company to ensure that the services offered meet the expectations of its Customers but also to comply with current laws.

8 – METHODS OF CONTACTING THE COMPANY AND/OR PERSONAL DATA CONTROLLER

8.1 – Person responsible for processing personal data collected on the ESPACE MOM Site or directly by ESPACE MOM

The person responsible for processing the Personal Data collected by the ESPACE MOM Company is responsible for determining the purposes and methods used to process Personal Data (hereinafter referred to as the “Data Controller”)

ESPACE MOM requests any Customer or Visitor who wishes to contact their Data Controller specify that said email is intended for the Data Controller in the email subject line.

8.2 – Obligations of the Data Controller;

We would like to point out that:

the Data Controller must protect the Personal Data collected on the ESPACE MOM Site or directly by ESPACE MOM and must not transmit or transfer it to Third Parties or Partners without informing the Customer or Visitor in advance, and has expressly accepted this and must respect the purposes for which this Personal Data is collected and processed;
the Data Controller must notify the Customer in the event of rectification or deletion of the Data, unless this involves disproportionate formalities, costs and procedures;
in the event that the integrity, confidentiality or security of the Customer’s or Visitor’s Personal Data is compromised, the Data Controller must inform the Customer or Visitor by any reasonable means.

8.3 – Personal Data Protection Officer

This Company has a Personal Data Protection Officer.

The role of the Personal Data Protection Officer is to ensure the proper implementation of national and supranational provisions relating to the collection and processing of Personal Data.

9 – YOUR RIGHTS REGARDING THE COLLECTION, PROCESSING, USAGE AND DISCLOSURE OF YOUR PERSONAL DATA

Pursuant to Law No. 78-17 of January 6, 1978 relating to data processing, files and freedoms, revised by law No. 2018-493 of June 20, 2018 and General Data Protection Regulation No. 2016/679, you have the right to view, rectify, transfer and delete Personal Data of yours that has been collected and processed by the ESPACE MOM Company, in particular on the ESPACE MOM Site.

You also have the right to object to and/or limit the processing of such Personal Data.

For the Personal Data Controller to grant this request, please communicate to us by email: (i) your first and last name so we can identify you and (ii) indicate the rights that you intend to claim.

The Personal Data Controller will respond to you within thirty (30) days of receiving your email.

If certain rights are exercised by the Customer, this may lead to the interruption of services offered by the Company, mostly those related to the collection and/or processing of personal data communicated by the Customer.

The exercise of any of rights by a Customer may under no circumstance call into question the Order of one (or more ) Device(s) on the ESPACE MOM Site for any reason whatsoever.

9.1 – Right of access, rectification and erasure

You have the right to (i) be made aware of and obtain communication, (ii) update, (iii) rectify and/or (iv) request the removal (deletion) of Personal Data concerning you, by sending your request in email to the Personal Data Controller at the following address: contact@espacemom.com

9.2 – Personal Data portability rights

You have the right to obtain Personal Data concerning you that has been collected by the ESPACE MOM Company in order to send it to another person in charge of processing personal data, by sending a request to the Personal Data Controller at the following email address: contact@espacemom.com

9.3 – Right to limit and object to the processing of personal data

You have the right to request limitation and/or object to the processing of your personal Data by ESPACE MOM. The Company may not refuse, except to demonstrate the existence of legitimate and compelling reasons, which may take precedence over your interests and rights.

9.4 – Right to determine the outcome of personal data collected and processed after death

10 – COOKIE USAGE

We use digital tools known as “Cookies” on our ESPACE MOM Site.

10.1 What is a cookie?

A cookie is a small file placed by a server and stored in a user’s terminal (computer, telephone, etc.) and associated with a web domain (in the majority of cases with all the pages of same website). This file is automatically returned during subsequent contacts with the same domain (Definition given by the CNIL).
